Department of Industrial Policy and Promotion is responsible
for implementation of Intellectual Property Rights regime in India, which relates
to Patents, Designs, Trade Marks and Geographical Indication of Goods and oversees
the initiative relating to their promotion and protection. These include the outlining
of policy and its implementation through the Office of the Controller General of
Patents, Designs and Trade Marks. It promotes awareness regarding protection of
the Intellectual Property Rights inherent in industrial property.
NID strives to encourage, creativity and innovation, which
in turn leads to generation of intellectual property. Protection of Intellectual
Property (IP) so generated is necessary to provide security, stimulation and incentives
for sustained and enhanced output. Moreover, in the context of ever shortening product
lifecycles and product differentiation and a market driven by vagaries, it is becoming
more and more essential to manage Intellectual Property Rights (IPR) effectively.
In 1999 the IPR Cell was first established as an entity
with a clear mandate of facilitating and guiding students and others in the various
aspects and issues in the field of IPR. The IPR cell at NID has organized many workshops,
sensitization programmes, seminars, besides getting IP registrations done.
Relevance
Innovators regularly use and create a great
deal of Intellectual Property and should strategically consider the steps required
for the same to protect, manage and enforce it.
Hence, it is well recognized that the awareness and knowledge of Intellectual
Property Rights is important and imperative for the designers. Many a times the
concept of Intellectual Property is misunderstood. It needs to demystify this important
but little understood concept.
Objective
To offer a comprehensive introduction to the
fundamental areas of Intellectual Property for creative design professionals and
innovators with specific reference to registration and protection
of Industrial designs under the Designs Act 2002.
It is also to demystify the myths prevailing with regards to Industrial Design
protection.

Anchor Faculty :
Shri Bhavin Kothari
Shri Bhavin Kothari is Associate Senior faculty in Strategic
Design Management at National Institute of Design. He is also heads the Intellectual
Property Rights Cell and International Center for Indian Crafts at NID. Mr Kothari
is a qualified Engineer–Planner and has pursued another master in Patents Law from
NALSAR University of Law.
He has been instrumental in facilitating and generating
IP awareness at NID. He also did a research study as an Anchor Researcher on
“Industrial Design as a tool of Competition for Indian
Industry” as part of IPR component of TIDP project of Government
of India and European Union. Mr. Kothari has attended, organized and presented at
many seminars and conferences.
